The provisions of these Documents are applicable to the Association, and are expressly subject to the terms, provisions, covenants, and conditions contained therein. The Binding Documents are recorded with the local govering authority. They include the Covenants and Restrictions, By-Laws and Articles of Incorporation upon which compliance is required by the Association Members, who subject to the terms, provisions, covenants and conditions contained in those Documents.
In addition to the governing documents, two Statutes, Fla 617 and 720, affect the administration and management of Homeowners Associations. You may notice that much of the language and wording in these Statutes can be found in the governing documents. Fla Statute 617 covers Not-For-Profit Corporations in general, so only some of the sections are relevant to Homeowner Associations. However, Fla Statute 720 is specifically titled "Homeowners Associations" and thus, is totally applicable as a source of state laws which govern the administration and management of Homeowners Associations and supersedes any and all governing documents of the Association.
